Tourism Law in Europe
9 4.2. Tourism Contracts Regulated in the Obligations Code 4.2.1. Overview Besides the protection established by the Package Travel Directive which was transposed into Slovenian law by the Consumer Protection Act, there are three types of tourism contracts provided for in the Slovenian Obligations Code: a) contract on organised travel 22 ; b) agency contract on tourist services 23 ; and c) allotment contract 24 . Statutory provisions dealing with these types of contracts were in 2001 (when the Obligations Code was adopted) without significant modifications transposed into Slovenian law from the Yugoslav Obligations Act of 1978 25 . When drafting the Yugoslav Obligations Act, the legislator mainly followed the wording of the UNIDROIT International Convention on Travel Contracts (CCV) of 1970 26 . Despite the fact that Slovenia is not a party of the Convention, national legislation on tourism contracts is still very similar to it. However, it should be noted that due to a rapid development of tourism industry in the last decades, the statutory contract law in the area of tourism is rather outdated. A small amount of case law dealing with the abovementioned types of tourism contracts supports this view. Hotel accommodation contracts and contracts on other hospitality services are not codified in the Slovenian law - with the exception of special set of rules on liability of hotel-keepers or other hospitality service providers concerning the property of their guests that can be found among the statutory provisions of contract of deposit 27 . These rules were introduced in the Slovenian law following the example of the Convention of the Council of Europe on the liability of hotelkeepers concerning the property of their guests of 1962 28 . 22 Articles 883-903. 23 Articles 904-908. 24 Articles 909-920. 25 Official Gazette of the Socialist Federal Republic of Yugoslavia, No. 29/78 with subsequent amendments. 26 Full text of the Convention available in https://www.unidroit.org/fr/ccv-r-official-languages-2/ccv-r- official-en. 27 Articles 741-746 of the Obligations Code. 28 Full text of the Convention is available in https://www.coe.int/en/web/conventions/full-list/- /conventions/rms/090000168006b648.
