12 between State Law and Regional Law immediately led to the intervention of the Constitutional Court, which declared a large part of the Code to be unconstitutional 20 . Therefore, the actual extent of the Tourism Code is now essentially limited to those rules that were not challenged by the Regions before the Constitutional Court and to the Code provisions relating to tourism professions, some general rules on tourism activities, the provisions on package travel contracts and the organisation of national tourism promotion. Despite its pompous name, the Tourism Code does not cover those areas which are, as we have seen, of the exclusive competence of State Law, namely general private law 21 . The Code, in its current structure, is divided into eight titles 22 and deals with tourism enterprises (artt. 4-5), tourism-related professions (artt. 6-7), accommodation facilities (artt. 8-17) and travel agencies (artt. 18-21). It also adresses, in a very general way, with various types of tourism (artt. 22-31), rental of tourist homes (artt. 52-53), tourist organisation, with particular reference to ENIT (artt. 54-65) and dispute resolution (artt. 66-69).
